These Terms of Service (“Terms”) govern your access to and use of the RichCues application and website at richcues.com (the “Service”), operated by RichCues (“we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms.

RichCues provides niche research and market intelligence tools for print-on-demand sellers using data accessed through marketplace APIs and trend services. You agree to use the Service only for lawful purposes and in accordance with these Terms.

You must not:

Use the Service to violate any applicable law or regulation
Attempt to reverse engineer, copy, or redistribute any part of the Service
Use the Service to transmit spam or unsolicited communications
Misrepresent your identity or affiliation when using the Service

2. Third-party platforms and APIs

RichCues uses third-party APIs — including the Etsy API and Google Trends — to surface publicly available market and trend data. Your use of features powered by these services may also be subject to their respective terms of use. RichCues is not affiliated with, endorsed by, or certified by any third-party platform referenced in the Service.

The term “Etsy” is a trademark of Etsy, Inc. This application uses the Etsy API but is not endorsed or certified by Etsy, Inc.

3. Intellectual property

All content, design, and code comprising the Service is owned by RichCues and protected by applicable intellectual property laws. You may not copy, reproduce, or distribute any part of the Service without our prior written consent.

4. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

5. Disclaimer of warranties

DISCLAIMER: THIS APPLICATION IS SOLELY PROVIDED BY RICHCUES (THE “APPLICATION DEVELOPER”). YOU ACKNOWLEDGE THAT ETSY, INC. AND ITS AFFILIATES ARE NOT THE APPLICATION DEVELOPER, DO NOT PROVIDE THE APPLICATION SERVICE, AND MAKE NO WARRANTIES OF ANY KIND WITH RESPECT TO THE APPLICATION OR DATA ACCESSED THROUGH IT.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
